The Nigerian Criminal Justice and Criminal Prosecution Under the Administration of Criminal Justice Act: New Wine in an Old Bottle

Abstract

In the Administration of Criminal Justice in Nigeria, the Directorate of Public Prosecution of the Federation (DPPF) is saddled with and undertakes a fundamental role in ensuring that justice is accomplished for all the parties involved, i.e the State, the victims, the accused person and the public. The DPPF is tasked with the onus of prosecution and bringing the alleged suspect to justice. However, the method(s) the DPPF is expected to apply in the prosecution of cases are bristling with challenges to the effective achievement of its role in the justice system.This paper is therefore necessitated by the need for a proper understanding of the challenges the prosecution faces in discharging it’s role in the administration of criminal justice. The paper adopted the doctrinal research methodology involving the use of primary and secondary sources in examining the issues. It concludes that this maybe that due to the way the criminal justice system is structured, that there should be a synergy between its institutions, i.e, the Police, the Directorate of Public Prosecution of the Federation and the Courts.
